Acceptance of Terms
By downloading, installing, or using the Tiffinly application or visiting our website, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our Service.
These Terms constitute a legally binding agreement between you ("User," "you") and Tiffinly ("Company," "we," "us"). We reserve the right to update these Terms at any time.
You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement.
Our Service
Tiffinly is a subscription-based food delivery platform that connects users with local home kitchens and tiffin services. Through our platform, you can:
- Browse and discover local kitchen partners ("Stores") near your delivery location.
- Subscribe to meal plans for regular delivery on chosen days and time slots.
- Manage, pause, skip, or cancel your active subscriptions.
- Track your delivery status in real time.
- Manage payments through your in-app wallet.
- Earn and redeem referral credits.
Tiffinly acts as an intermediary platform connecting users with independent kitchen partners. We do not prepare, handle, or take responsibility for the food itself. Food safety, quality, and hygiene are the sole responsibility of the individual kitchen/store partners.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
User Accounts
To access most features of Tiffinly, you must create an account. When creating your account, you agree to:
- Provide accurate, current, and complete information.
- Maintain and promptly update your account information.
- Keep your password confidential and not share it with anyone.
- Be responsible for all activities that occur under your account.
- Notify us immediately of any unauthorised use of your account.
You may not create more than one account per person. Accounts created for fraudulent purposes, including to abuse referral programmes, will be terminated.
We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for an extended period, or are associated with fraudulent activity.
Subscriptions
When you subscribe to a meal plan through Tiffinly, you agree to the following terms:
- Subscription Period: Subscriptions cover a fixed period (weekly, monthly, or custom) as selected at checkout. The delivery schedule is set at the time of subscription.
- Skip Deliveries: You may skip individual deliveries before the scheduled delivery time as permitted by the store's skip policy. Skipped deliveries are not automatically refunded but may extend your subscription or credit your wallet, subject to the store's terms.
- Pause: You may pause your subscription for a specified number of days as allowed by the platform. Pause limits may apply.
- Meal Changes: Changes to the meal type or plan may be subject to the store's policies and may not always be possible after a subscription has started.
- Address Changes: You may update your delivery address before the day's delivery is dispatched. Significant address changes (outside the store's delivery zone) may require cancellation and re-subscription.
Subscriptions are between you and the kitchen partner. Tiffinly facilitates the transaction but is not a party to the subscription agreement itself. Any disputes regarding food quality should first be raised with the kitchen through our support channel.
Payments & Wallet
All prices displayed on the platform are in the local currency and include applicable taxes unless stated otherwise. Prices may vary by kitchen partner and are subject to change.
Wallet: Tiffinly provides an in-app wallet. Wallet credits can be earned through referrals, promotional offers, or manual top-ups. Credits are non-transferable, have no cash value, and expire as per the terms of the specific offer or promotion.
Payment Methods: We accept payments via the methods listed at checkout (which may include UPI, credit/debit cards, net banking, and wallet balance). Payment processing is handled by third-party gateways that comply with applicable security standards.
Failed Transactions: If a payment fails or is declined, your subscription may not be activated or renewed until successful payment is received. We are not liable for any loss arising from failed payments.
Pricing Errors: In the event of a pricing error, we reserve the right to cancel orders placed at the incorrect price and notify you accordingly.
Cancellation & Refunds
Cancellation Policy:
- You may cancel your subscription at any time through the app. Cancellation takes effect immediately.
- For any remaining deliveries at the time of cancellation, refund eligibility is determined by the kitchen partner's policy.
- Cancellations made within 24 hours of a scheduled delivery are generally not eligible for a refund for that delivery.
Refund Policy:
- Refunds, if applicable, will be processed to your original payment method or Tiffinly wallet within 5–7 business days.
- Refunds are considered in cases of: non-delivery, significant quality issues (with evidence), or incorrect orders.
- Promotional discounts, referral credits, and wallet bonuses are non-refundable.
- We reserve the right to refuse a refund if we determine the claim is fraudulent or unjustified.
To request a refund, please contact our support team within 48 hours of the delivery date with your order details and reason.
Delivery Policy
Delivery Zones: Delivery is available only within the zones supported by the kitchen partner. Delivery zones are determined by the kitchen and may change without prior notice.
Delivery Time: Each kitchen specifies a delivery window (e.g., 12:00 PM – 2:00 PM). While we strive to deliver within these windows, delays may occur due to traffic, weather, or high demand. We are not liable for delays beyond our reasonable control.
Delivery Fees: Delivery charges, if applicable, are displayed at checkout. These fees may vary by distance, kitchen partner, or promotional periods.
Failed Deliveries: If a delivery cannot be completed due to an incorrect address, inaccessible location, or recipient unavailability, the delivery may be marked as attempted. No refund is issued for failed deliveries caused by the user.
Contactless Delivery: Riders may leave your order at the door or a designated spot. Tiffinly is not responsible for food after it has been delivered to the stated address.
Acceptable Use
You agree to use Tiffinly only for lawful purposes and in accordance with these Terms. You must NOT:
- Use the Service for any fraudulent, illegal, or harmful purpose.
- Abuse the referral programme (e.g., self-referrals, fake accounts).
- Post false, misleading, or defamatory reviews about kitchens or riders.
- Attempt to reverse-engineer, hack, or otherwise compromise the platform.
- Use automated bots or scripts to interact with the Service.
- Harass, threaten, or abuse kitchen staff, riders, or other users.
- Upload or transmit viruses, malware, or any harmful code.
- Circumvent any security measures or access controls.
- Collect or harvest other users' data without their consent.
- Impersonate any person or entity, including Tiffinly staff.
Violation of these rules may result in immediate account suspension or termination, forfeiture of wallet credits, and/or legal action where applicable.
Intellectual Property
All content on the Tiffinly platform — including the logo, brand name, design, text, graphics, software, and code — is owned by or licensed to Tiffinly and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use. This licence does not include the right to:
- Reproduce, distribute, or publicly display any content from the platform.
- Create derivative works based on the platform or its content.
- Use our trademarks, logos, or brand elements without prior written permission.
Any feedback, suggestions, or ideas you submit to us may be used by Tiffinly without obligation or compensation to you.
Limitation of Liability
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
To the maximum extent permitted by applicable law, Tiffinly shall not be liable for:
- Any food quality, hygiene, or safety issues — these are the responsibility of the kitchen partners.
- Indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Any loss of data, profits, or goodwill.
- Delays or failures in delivery due to third-party logistics or circumstances beyond our control (force majeure).
- Losses arising from unauthorised access to your account where you have not taken reasonable precautions.
Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to Tiffinly in the 3 months preceding the claim.
Termination
Either party may terminate this agreement at any time:
- By you: Delete your account via Account → Settings → Delete Account. Deletion is irreversible and removes all your personal data (subject to legal retention requirements).
- By us: We reserve the right to suspend or permanently terminate your account, with or without notice, for violation of these Terms, fraudulent activity, or any other reason at our sole discretion.
Upon termination, your licence to use the Service is revoked, and any outstanding wallet credits may be forfeited if termination is due to a policy violation.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved amicably. If not resolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts located in India.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page.
- Send a notification via in-app alert or email for significant changes.
- Provide at least 15 days' notice before material changes take effect.
Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and delete your account.
